Terms of Use

Welcome to Bizora. These Terms of Use govern your access to and use of our digital platform designed to support and develop small businesses and entrepreneurship in South Africa. By accessing or using Bizora's services, you agree to be bound by these terms. Please read them carefully.

Acceptance of Terms and Eligibility

By creating an account, accessing our platform, or using any of Bizora's services, you agree to these Terms of Use and our Privacy Policy:

Agreement to Terms:

These terms constitute a legally binding agreement between you and Bizora. If you do not agree with any part of these terms, you must not use our platform. Your continued use of the services constitutes acceptance of any modifications to these terms.

Eligibility Requirements:

You must be at least 18 years old and have the legal capacity to enter into binding contracts under South African law. If you are registering on behalf of a business entity, you represent that you have the authority to bind that entity to these terms. You must provide accurate, current, and complete information during registration and maintain the accuracy of this information.

Account Registration:

To access certain features of the Bizora platform, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any security breach.

Prohibited Users:

We reserve the right to refuse service, terminate accounts, or remove content at our discretion, particularly if we suspect fraudulent activity, violation of these terms, or behavior that may harm other users or our platform's reputation.

Services and Platform Use

Bizora provides a comprehensive digital platform for small business support with the following services and conditions:

Platform Services:

Our platform offers business consultations, mentorship programs, training modules, financial tools, networking opportunities, success stories, and resources tailored to South African entrepreneurs and SME owners. Services may be updated, modified, or discontinued at any time without prior notice.

Acceptable Use:

You agree to use Bizora solely for lawful business purposes. You will not use the platform to transmit harmful, offensive, or illegal content; engage in fraudulent activities; harass or harm other users; attempt to gain unauthorized access to our systems; interfere with platform operations; or impersonate others. You will not scrape, harvest, or collect user data without authorization.

Content Submission:

When you post content, including business profiles, success stories, forum posts, or reviews, you grant Bizora a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display this content in connection with our services. You retain ownership of your content and are responsible for ensuring you have the right to share it.

Third-Party Services:

Bizora may integrate with or link to third-party services, including payment processors, training providers, or business tools. We are not responsible for the availability, content, or practices of these third-party services. Your use of third-party services is governed by their respective terms and policies.

Service Availability:

While we strive to provide uninterrupted access, we do not guarantee that the platform will be available at all times. We may suspend or restrict access for maintenance, updates, security issues, or other operational reasons. We are not liable for any unavailability or interruption of services.

Intellectual Property Rights

Bizora and its content are protected by intellectual property laws. These rights govern your use of our platform:

Bizora's Property:

All content on the Bizora platform, including but not limited to text, graphics, logos, images, training materials, software, algorithms, and compilation of user content, is the property of Bizora or its licensors and is protected by South African and international copyright, trademark, and other intellectual property laws.

Limited License:

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Bizora platform for your personal business purposes in accordance with these terms. This license does not include the right to download, copy, modify, distribute, sell, or create derivative works from our content without explicit written permission.

Trademarks:

The Bizora name, logo, and all related product and service names are trademarks of Bizora. You may not use these trademarks without our prior written consent. Other trademarks appearing on our platform are the property of their respective owners.

User Content Rights:

You retain all intellectual property rights to content you create and post on our platform. By submitting content, you represent that you own or have permission to use the content and that it does not infringe on any third-party rights. You grant other users limited rights to view and interact with your publicly shared content as intended by the platform's functionality.

Copyright Infringement:

We respect intellectual property rights and expect our users to do the same. If you believe content on our platform infringes your copyright, please contact us at [email protected] with detailed information about the alleged infringement. We will investigate and take appropriate action in accordance with South African copyright law.

Fees, Payments, and Refunds

Bizora offers both free and paid services. The following terms apply to all financial transactions:

Service Fees:

Certain features, including premium mentorship programs, advanced training modules, or specialized financial tools, may require payment. All fees are displayed in South African Rand (ZAR) and are subject to applicable taxes. We reserve the right to modify fees at any time, with notice to existing subscribers at least 30 days before changes take effect.

Payment Terms:

Payments are processed through secure third-party payment processors. You agree to provide accurate payment information and authorize us to charge your chosen payment method. Subscription fees are billed in advance on a recurring basis according to your selected plan (monthly, quarterly, or annually). You are responsible for all charges incurred under your account.

Refund Policy:

We offer a 14-day money-back guarantee for first-time subscribers to paid plans. Refund requests must be submitted within 14 days of the initial purchase by contacting [email protected]. After this period, all fees are non-refundable. Refunds are not available for partial subscription periods or unused portions of services. Processing refunds may take 10-15 business days.

Subscription Cancellation:

You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of the current billing period. You will continue to have access to paid features until the end of the period you have paid for. No prorated refunds are provided for early cancellation.

Taxation:

All fees are subject to applicable Value Added Tax (VAT) and other taxes as required by South African law. VAT-registered businesses must provide their VAT registration number to receive appropriate invoicing.

Disclaimers and Limitation of Liability

Your use of Bizora is subject to the following disclaimers and limitations:

Service Disclaimer:

The Bizora platform and all services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the platform will be uninterrupted, error-free, secure, or free from viruses or other harmful components. We make no guarantees regarding the accuracy, completeness, or reliability of any content, advice, or information provided through our platform.

Business Advice Disclaimer:

Content on Bizora, including consultations, training materials, and mentorship advice, is for informational and educational purposes only. It does not constitute professional financial, legal, or business advice. We recommend consulting with qualified professionals before making significant business decisions. We are not responsible for any business outcomes, profits, losses, or decisions made based on information obtained through our platform.

Limitation of Liability:

To the fullest extent permitted by South African law, Bizora, its directors, employees, partners, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities, arising from your use or inability to use our services, even if we have been advised of the possibility of such damages.

Maximum Liability:

Our total aggregate liability to you for all claims arising from or related to these terms or your use of Bizora shall not exceed the amount you paid to us in the twelve months preceding the claim, or ZAR 1,000, whichever is greater.

User Interactions:

We are not responsible for the conduct of other users, mentors, or third parties you interact with through our platform. Any dealings between you and other users, including business partnerships, investments, or service agreements, are solely between you and the other party. You release Bizora from all claims arising from such interactions.

General Provisions

The following general provisions complete these Terms of Use:

Governing Law:

These terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these terms or your use of Bizora shall be subject to the exclusive jurisdiction of the courts of Cape Town, South Africa. You agree to submit to the personal jurisdiction of these courts.

Modifications to Terms:

We reserve the right to modify these Terms of Use at any time. We will notify you of material changes via email and platform notification at least 30 days before they take effect. Your continued use of Bizora after the effective date of modifications constitutes acceptance of the updated terms. If you do not agree with the changes, you must stop using our services and may close your account.

Termination:

We may suspend or terminate your account and access to Bizora at any time, with or without cause, and with or without notice, for violations of these terms, fraudulent activity, extended inactivity, or any reason at our discretion. Upon termination, your right to use the platform immediately ceases. Provisions regarding intellectual property, disclaimers, and limitations of liability survive termination.

Severability:

If any provision of these terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
